Can I use my HSA to purchase prescription drugs from a foreign country?

 You cannot include the cost of your prescribed drug brought in or shipped from another country.  If the prescription medication was imported legally, you can include the expense. If the Food and Drug Administration announces it can be legally imported by individuals, you can include the cost as an eligible expense.

 If the prescription drug you purchase and consume in a another country  is legal in both the United States and the other country, you can include it as an eligible expense.

 

Example #1

If you are traveling abroad in Germany and get an infection then the  doctor could  prescribe penicillin. Penicillin is legal in  the United States and as long as it is legal in Germany it is an eligible expense.

Example #2

If I live in Texas and I am prescribed penicillin and I drive to Mexico to get the medication then it is not an eligible expense.  This is because the drug is not imported legally.
